Terms of Use for SimKit

1. Acceptance of Terms

By downloading, installing, or using SimKit (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. License Grant

2.1 Free Tier License

SimKit grants you a non-exclusive, non-transferable, revocable license to use the free features of the App for personal and commercial use, subject to these Terms.

2.2 Pro Tier License

If you purchase a Pro subscription:

You receive access to premium features for the duration of your subscription
License is personal and non-transferable
Subscription may be monthly or annual, as selected during purchase
All purchases are processed through the Apple App Store

2.3 Restrictions

You may NOT:

Reverse engineer, decompile, or disassemble the App
Remove or modify any copyright notices or proprietary markings
Use the App for illegal purposes or in violation of any laws
Share your Pro subscription access with others
Redistribute or resell the App or any of its features
Use the App to harm, interfere with, or exploit minors
Attempt to circumvent subscription or payment mechanisms

3. Subscription Terms

3.1 Billing

Subscriptions are billed through your Apple ID account
Payment is charged at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period

3.2 Cancellation

You can cancel your subscription anytime through App Store account settings
Cancellation takes effect at the end of the current billing period
No refunds for partial periods
Free tier features remain available after cancellation

3.3 Price Changes

We reserve the right to change subscription prices
Price changes will be notified at least 30 days in advance
Existing subscribers will be grandfathered at their current price for one additional billing cycle

Promo codes may be offered for promotional purposes
Promo access is subject to availability and may be revoked at any time
Promo codes are non-transferable and have no cash value
We reserve the right to deactivate fraudulent or abused promo codes

4. Acceptable Use

4.1 Permitted Uses

SimKit is designed for:

iOS and macOS app development and testing
Quality assurance and debugging
UI/UX design and prototyping
Educational purposes for learning iOS development
Creating screenshots and videos for App Store submissions

4.2 Prohibited Uses

You may NOT use SimKit to:

Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Harass, abuse, or harm another person
Create malicious or harmful applications
Bypass security features of any system or application
Violate Apple’s Developer Program License Agreement
Test or develop apps that violate App Store guidelines

5. Intellectual Property

5.1 Ownership

SimKit and all associated intellectual property rights are owned by Emre Can Altaca. This includes:

App source code and architecture
UI/UX design and visual assets
App name, logo, and branding
Documentation and tutorials

5.2 User Content

Content you create using SimKit (screenshots, videos, etc.) remains your property
We claim no ownership over your simulator content or test data
You are responsible for ensuring you have rights to any content you test or capture

5.3 Trademarks

“SimKit” and the SimKit logo are trademarks of Emre Can Altaca. Unauthorized use is prohibited.

6. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

Warranties of merchantability and fitness for a particular purpose
Non-infringement of third-party rights
Uninterrupted or error-free operation
Accuracy or reliability of results

Your use of SimKit is at your own risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, revenue, or data
Loss of use or business interruption
Cost of substitute services
Damage to devices or systems

Maximum liability: If we are found liable, our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

8. Simulator and System Requirements

8.1 Compatibility

SimKit requires:

macOS 14.0 or later
Xcode and iOS Simulator installed
Valid Apple Developer account (free or paid)
Screen Recording and Accessibility permissions

8.2 No Affiliation with Apple

SimKit is an independent third-party tool and is not affiliated with, endorsed by, or sponsored by Apple Inc. Xcode and iOS Simulator are products of Apple Inc.

8.3 Simulator Limitations

SimKit functionality depends on Apple’s iOS Simulator
We are not responsible for simulator bugs or limitations
Some features may not work with all simulator versions

9. Updates and Changes

9.1 App Updates

We may release updates to fix bugs, add features, or improve performance
Updates may be required for continued use
We do not guarantee backward compatibility with all features

9.2 Changes to Terms

We reserve the right to modify these Terms at any time
Material changes will be notified through the App or App Store
Continued use after changes constitutes acceptance of new Terms

9.3 Service Changes

We reserve the right to:

Modify, suspend, or discontinue any features
Change subscription pricing with notice
Limit or restrict access to certain features

10. Privacy and Data

Your use of SimKit is also governed by our Privacy Policy.

Local data stays on your device
We do not sell your data to third parties

11. Third-Party Services

SimKit integrates with:

Firebase Analytics: For usage analytics and crash reporting
RevenueCat: For subscription management
Apple StoreKit: For in-app purchases

Your use of these services is subject to their respective terms and policies.

While we strive to provide support, we do not guarantee:

13. Termination

13.1 By You

You may stop using SimKit at any time by:

Uninstalling the App from your Mac
Canceling your subscription (if applicable)

13.2 By Us

We reserve the right to:

Suspend or terminate your access for violations of these Terms
Discontinue the App entirely with reasonable notice
Block access for fraudulent or abusive behavior

13.3 Effect of Termination

Upon termination:

Your license to use the App ends immediately
Pro features become inaccessible
No refunds for remaining subscription period (unless required by law)
Local data remains on your device until manually deleted

14. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.

Dispute Resolution:

Informal resolution: Contact us first to resolve disputes
Jurisdiction: Courts of Turkey have exclusive jurisdiction
No class actions: Disputes must be resolved individually

15. Apple App Store Requirements

Additional Terms for App Store Users:

These Terms are between you and Emre Can Altaca, not Apple
Apple has no obligation to provide support or warranty
Apple is not responsible for the App or its content
Apple is a third-party beneficiary and may enforce these Terms
You must comply with Apple’s App Store Terms of Service

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding SimKit.

18. Open Source Components

SimKit may include open-source software components. Licenses for these components can be found in the App’s “About” section or on our GitHub repository.

19. Export Compliance

You agree to comply with all applicable export and import control laws and regulations, including those of the United States and Turkey.

20. Feedback and Suggestions

If you provide feedback, suggestions, or ideas:

We may use them without obligation to you
You grant us a perpetual, worldwide, royalty-free license
We are not required to implement or acknowledge your suggestions
